School Administration by Law: Values, Content and Strategies

摘要: 依法治校的精神关系到依法治校在我国的实施和实现。其科学内涵应当包括学校具有法律地位、具有法治思维、具有法律人格、具有法律行为等方面。其法治价值在于实现学校治理的法治理性,它应当从学校治理体系、法治社会和法治国家等方面得到诠释。依法治校是实实在在的,它的基本内容构成体现于法律渊源、法律主体、法律权利义务、法律效力等环节。在依法治国的大背景下,依法治校的实现路径也是依法治校精神的题中之意,应当通过依法定位学校、依法治理学校、依法评估学校、依法助益学校等路径予以实现。Abstract: The fulfillment of school administration by law in China lies in the spirit of school administra-tion by law, the scientific connotation of which involves school's legal status, rule of law thinking, legal personality and legal act. The values in rule of law is to achieve the rationality in administration of law, which can be interpreted from the aspects of school administration system, law-based society and law-based govern-ment. School Administration by law is concrete, and its basic contents are reflected in legal sources, legal entity, legal rights and duties and legal effects. In the context of rule of law, how to implement school administration by law is a major concern, which could be addressed by defining school by law, administrating school by law, assessing school by law and benefiting school by law.
